Terms of Use

These terms are an agreement between you and [Company legal name] (“we”, “us”) about the Capyfill: Water Tracker app (“Capyfill” or “the app”) and Capyfill Premium. By downloading or using the app you agree to them. If you don’t agree, please don’t use the app.

1. Using Capyfill

We give you a personal, non-exclusive, non-transferable licence to use Capyfill on devices you own or control, for your own non-commercial use, as allowed by the rules of the store you got it from. How we handle information is explained in our Privacy Policy.

2. Not medical advice

Capyfill is a general wellness app, not a medical device. The daily goal, the hydration percentage of each drink, reminders, challenges and everything else in the app are general estimates based on what you enter. They are not medical advice and may not suit you.

• Talk to a doctor before changing how much you drink, especially if you are pregnant or breastfeeding, have a heart, kidney or liver condition, have been told to limit fluids, or take medicine that affects your fluid balance.
• Drinking too much water in a short time can be dangerous. Listen to your body; you don’t have to reach a goal at any cost.
• Caffeine and alcohol amounts are typical values, not measurements. Logging alcohol in the app is not a recommendation to drink it.

If you feel unwell, seek medical help. In an emergency, call your local emergency number.

3. Capyfill Premium

Capyfill Premium unlocks extra features, which the app describes before you buy, such as every beverage, the challenges and editing past days. The rest of the app stays free.

Plans and prices

• Lifetime: a one-time purchase. There are no further payments, and Premium stays on for as long as we offer Capyfill.
• Yearly: a subscription that renews automatically every year.
• The price, in your currency, is shown in the app and on the store’s confirmation screen before you buy. Prices can differ between countries, and taxes may apply.

Payment and automatic renewal

• Payment is charged to your Apple Account or Google account when you confirm the purchase.
• The Yearly subscription renews automatically at the end of each year unless you cancel it at least 24 hours before the current year ends. Your account is charged for the renewal within the 24 hours before the year ends.
• If we change the subscription price, Apple or Google will tell you in advance and, where the law or their rules require it, ask you to agree before the new price applies.

Free trial

• The Yearly plan may start with a free trial, shown before you buy. Unless you cancel at least 24 hours before the trial ends, the subscription starts and the first year is charged.
• Trials are for new subscribers; the store decides whether your account can have one.
• If you buy a plan during a free trial, any time left in the trial ends.

Cancelling

You can turn off automatic renewal at any time in your store account. Premium stays on until the end of the period you already paid for.

• iPhone: Settings › your name › Subscriptions › Capyfill.
• Android: Google Play › your profile picture › Payments & subscriptions › Subscriptions › Capyfill.

Deleting the app does not cancel a subscription.

Refunds

Purchases are made with Apple or Google, so refunds are handled by them under their policies (reportaproblem.apple.com for the App Store; Google Play’s order history for Google). We can’t issue refunds ourselves. This doesn’t affect any refund rights you have by law.

Restoring purchases

Premium belongs to the App Store or Google Play account you bought it with. On a new phone, or after reinstalling, tap “Restore purchases” on the Premium screen while signed in to the same account. A purchase on the App Store doesn’t carry over to Google Play, or the other way round.

4. Your data

The drinks you log and your settings are stored only on your phone. We don’t keep a copy, so we can’t recover them if your phone is lost or reset or the app is deleted. Your phone’s own backup (iCloud or Google) may keep a copy, depending on its settings.

5. Fair use

Please don’t copy, sell, rent or redistribute the app, get around Premium or its purchases, try to extract the app’s source code (except where the law allows it), or use the app in a way that breaks the law or harms others.

6. What belongs to us

The app, its name, the capybara character, its artwork and its content belong to us or our licensors and are protected by law. These terms don’t give you any rights to them beyond using the app. If you send us ideas or feedback, we may use them without owing you anything.

7. Changes to the app

We keep improving Capyfill, so features may change. We may also stop offering the app, but if we take away what Premium includes in a way that matters to you, we will tell you in advance; for a subscription, you can cancel it before your next renewal.

8. Disclaimer

We work hard to make Capyfill reliable, but as far as the law allows, the app is provided “as is” and “as available”, without promises that it will always work, be free of errors, or meet your particular needs.

9. Limits on our liability

As far as the law allows, we are not liable for indirect or unforeseeable losses, or for lost data, and our total liability to you is limited to what you paid for Capyfill in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by negligence, or for fraud.

10. Your rights as a consumer

These terms don’t take away any rights you have under the consumer protection laws of the country where you live. If something goes wrong, please contact us first and we will try to put it right.

11. App Store and Google Play

If you got Capyfill from the App Store, Apple’s Licensed Application End User License Agreement also applies, and these terms add to it. In that case:

• these terms are between you and us, not Apple, and we, not Apple, are responsible for the app, its support and maintenance, and any claims about it (including product liability, legal compliance and intellectual property claims);
• if the app fails to meet any warranty that applies, you can tell Apple, and Apple will refund the price you paid for the app (if any); as far as the law allows, Apple has no other warranty obligation;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you got Capyfill from Google Play, the Google Play Terms of Service also apply to your purchases.

12. Ending these terms

You can stop using Capyfill at any time by deleting it (remember to cancel any subscription separately). If you seriously break these terms, we may end your licence to use the app.

13. Changes to these terms

We may update these terms, for example when we add features or the law changes. We will change the date at the top, and tell you in the app before any significant change takes effect. If you keep using Capyfill after that, the new terms apply.
